Terms and Conditions of Use and Sale

These terms and conditions of use and sale ("Terms") define the terms and conditions of access to and use of the Pok Genius platform, accessible at www.pokgenius.com, as well as the conditions under which the Subscriptions, Bootcamps and coaching services offered on the Platform are sold.

Registration, use of the Platform or any order implies full and complete acceptance of these Terms. The applicable version is the version in force on the day of the order.

• Platform: the pokgenius.com website and all of its features
• User: any person accessing the Platform
• Member: any User with an account on the Platform
• Publisher: the company publishing the Platform (see Legal Notice)
• Content: all information, text, images, videos and data available on the Platform
• Subscription: a paid plan, of monthly or annual duration, giving access to the features described in the subscribed offer
• Bootcamp: an online group training session organized on a specific date
• Coaching: an individual session with a coach, scheduled on an agreed date

Pok Genius is an online poker training platform offering:

• Ranger GTO: a library of interactive preflop and postflop ranges with frequencies and EV
• Trainer GTO: hand-by-hand training with instant feedback
• Pro Videos: strategy videos by professional coaches
• Pro Coaching: live coaching sessions with professionals
• Bootcamps: online group training sessions organized on specific dates

Access to certain features requires the creation of an account. The User agrees to provide accurate information and to maintain the confidentiality of their credentials. Any activity carried out from an account is deemed to have been carried out by the account holder.

The User must be at least 18 years old to create an account. By registering, the User confirms that they are of legal age.

The account is strictly personal: sharing credentials or the use of a single account by several people is prohibited.

The User agrees to:

• Use the Platform in accordance with its intended purpose and these Terms
• Not attempt to access the data of other users
• Not reproduce, copy or redistribute the content of the Platform
• Not use robots, scrapers or any automated data extraction device
• Not disrupt the operation of the Platform

The Platform offers Subscription plans (monthly or annual) giving access to all or part of its features, as well as one-off services (Bootcamps, Coaching). The details of the offers and their prices, expressed in euros inclusive of all taxes (VAT included), are displayed on the Platform before any order is placed.

Payment is made online by bank card through our secure payment provider Stripe. No banking data is stored by the Publisher. Payment is taken upon subscription and then, for Subscriptions, at each renewal date.

The Publisher may change its prices at any time. For current Subscriptions, any new price is communicated to the Member at least thirty (30) days before it applies and only takes effect from the next renewal date; the Member remains free to cancel before that date.

In the event of a payment failure, access to paid features may be suspended after notification, and the Subscription then terminated if the situation is not remedied.

The Platform also offers Genius Coins packs, bought in a single payment (section 17). Their price in euros including VAT and the number of coins they contain are displayed before any order; payment is made by card through Stripe and the coins are credited to the Member's account immediately.

Subscriptions are taken out for a period of one (1) month or one (1) year depending on the plan chosen. They renew automatically by tacit renewal for an identical period, unless cancelled by the Member before the end date of the current period.

The Member may cancel their Subscription at any time, free of charge and without justification, from their personal area (Profile → Subscription, secure management portal) or by contacting support. Cancellation takes effect at the end of the current period: the Member retains access to paid features until that date, and no further payment is taken afterwards. The current period remains due and is not refunded, even partially (see article 9).

The Member may change plans at any time. When upgrading to a higher plan, the price difference is calculated pro rata for the remaining period; when downgrading to a lower plan, the change takes effect at the next renewal date.

In accordance with Article L215-1 of the French Consumer Code, reproduced below:

"For fixed-term service contracts containing a tacit renewal clause, the professional service provider shall inform the consumer in writing, by dedicated personal letter or email, no earlier than three months and no later than one month before the end of the period allowing rejection of the renewal, of the possibility of not renewing the contract concluded with a tacit renewal clause. This information, provided in clear and comprehensible terms, shall state, in a prominent box, the deadline for non-renewal. Where this information has not been sent to the consumer in accordance with the provisions of the first paragraph, the consumer may terminate the contract free of charge at any time from the renewal date. Advance payments made after the last renewal date or, in the case of contracts of indefinite duration, after the date of conversion of the initial fixed-term contract, shall in that case be reimbursed within thirty days from the termination date, less the sums corresponding, up to that date, to the performance of the contract. The provisions of this article apply without prejudice to those which legally subject certain contracts to specific rules regarding consumer information." In accordance with Article L221-18 of the French Consumer Code, consumers in principle have a period of fourteen (14) days to exercise their right of withdrawal from a contract concluded at a distance. This right is however subject to statutory exceptions that apply to the services offered on the Platform:

• Subscriptions and digital content: in accordance with Article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium where performance has begun before the end of the withdrawal period. By taking out a Subscription, the Member expressly requests immediate access to all the content and features covered by their plan, and acknowledges that they expressly waive their right of withdrawal as soon as this access is granted. This consent and waiver are collected at the time of payment.
• Bootcamps: in accordance with Article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure activity services to be provided on a specific date or during a specific period. Registration for a Bootcamp is therefore final upon payment.
• Coaching: coaching sessions scheduled for a specific date fall under the same exception. For services not covered by it, a Member who requests performance of the service before the end of the withdrawal period expressly waives this right once the service has been fully performed (Article L221-28, 1°).

Genius Coins packs: coins are digital content supplied without a tangible medium, credited and usable as soon as payment is made. By confirming the order, the Member requests this immediate performance and expressly waives, from that moment, the right of withdrawal, under point 13° of Article L221-28 of the French Consumer Code. This consent is collected at the time of payment.

Subject to statutory warranties and to the cases expressly provided for by law:

• Amounts paid for a Subscription are non-refundable. Cancellation takes effect at the end of the period and the current period remains acquired by the Publisher, including if the Member does not use, or no longer uses, the service.
• Bootcamp registrations and Coaching session purchases are non-refundable, except in the event of cancellation by the Publisher: in that case, the Member is fully refunded within fourteen (14) days, or offered a transfer to a later session.

These provisions do not deprive the Member of the statutory warranty of conformity applicable to digital content and services (Articles L224-25-1 et seq. of the French Consumer Code) or of any right that cannot be waived. In the event of a service malfunction, the Member is invited to contact support at contact@pokgenius.com.

Genius Coins packs are non-refundable once the coins have been credited, and the coins themselves, whether earned or bought, can be neither refunded nor converted into money (section 17). If a payment is refunded or disputed through the bank, the corresponding coins are removed from the account.

Bootcamps: Bootcamps are online group training sessions, organized on specific dates and subject to available places. Registration is only final after full payment. The program, dates, duration and price of each Bootcamp are specified on its presentation page. The Publisher may cancel a Bootcamp, in particular if the number of participants is insufficient; the Member is then informed as early as possible and fully refunded or, at their choice, registered for a later session.

Coaching: individual coaching sessions are scheduled by mutual agreement with the coach. Any session cancelled by the Member less than 48 hours before the agreed time, or not attended, remains due. A session cancelled by the coach is rescheduled free of charge.

All content on the Platform (text, images, videos, software, databases, ranges, algorithms) is protected by intellectual property law and belongs exclusively to the Publisher.

Access to the Platform does not grant the User any intellectual property rights over the content. Any unauthorized reproduction or use is strictly prohibited.

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

The plan subscribed to by the Member (Pro, Elite, Genius) is shown next to their display name to other signed-in Members. The Member can hide it in their profile.

The Platform is provided "as is". The Publisher strives to ensure the availability and reliability of the service, but does not guarantee uninterrupted or error-free operation.

The Publisher cannot be held liable for:

• Temporary service interruptions for maintenance or updates
• The results obtained by the User in their poker practice
• The User's use of the information and content of the Platform
• Indirect damages resulting from the use of the service

Warning: Pok Genius is a training tool. Poker involves financial risks. The GTO strategies presented are theoretical references and do not guarantee gains.

The Publisher reserves the right to modify these Terms at any time. Changes are brought to Users' attention on the Platform, by updating the date shown at the top of these Terms; the online version applies from that date.

Continued use of the Platform after modification constitutes acceptance of the new Terms. Orders already placed remain governed by the version accepted on the day of the order.

The Member may delete their account at any time from Settings → Account → "Delete my account", or by contacting support. Deleting the account does not in itself terminate a current Subscription: the Member is invited to cancel their Subscription beforehand (article 7).

The Publisher may suspend or delete an account in the event of a violation of these Terms (in particular account sharing, content extraction, fraud), after notifying the User. In the event of a serious violation, the suspension may be immediate and does not give rise to any refund.

These Terms are governed by French law. They are drawn up in French; in the event of any discrepancy between the French version and a translation, the French version shall prevail.

In the event of a dispute, the parties undertake to seek an amicable solution before any legal action: the Member may send a written complaint to support (contact@pokgenius.com).

In accordance with Articles L611-1 et seq. of the French Consumer Code, the consumer may, after first submitting a written complaint to the Publisher that has not received a satisfactory response, have free recourse to a consumer mediator. The contact details of the competent mediator are available on request from support and will be published on this page as soon as the mediator is appointed.

Failing an amicable resolution, the French courts shall have jurisdiction under the conditions of ordinary law.

Definition. Genius Coins (“coins”) are a virtual unit specific to the Platform. They have no monetary value, are neither electronic money nor a means of payment, and cannot be converted into money, refunded, transferred or assigned to another account, nor used outside the Platform.

How coins are obtained. Coins are obtained by training on the Platform (daily milestones, rewards, streaks, challenges, progression programme), through bonuses granted by the Publisher, or by buying coin packs (section 6). Earning scales and prices in coins are displayed on the Platform and may change; a change only applies to later earnings and purchases and never alters a balance already acquired.

Use. Coins are used solely to obtain digital items of the Platform: unlocking videos for the Member's account, entering training games against bots (“Bot Battle”), additional Replayer analyses, cosmetic items. An unlocked item stays attached to the Member's account for the life of that account. Features included in the Member's Subscription are never charged in coins.

Bot Battle. A game against bots is a training service: the entry fee in coins is not a stake, no game pays out coins or winnings of any kind, and the result grants no advantage of any value. The entry fee is refunded in coins if the game could not start.

Duration and loss. Purchased coins do not expire. Coins obtained free of charge may be capped, revalued or withdrawn in the event of fraud, abuse or any scheme to obtain them by automated means. Deleting the account, whether at the Member's request or by the Publisher under section 15, results in the permanent loss of the coins, without compensation.

Changes. The Publisher may change the catalogue of items available for coins, their price in coins and the packs offered. Prices in coins are those displayed at the time of the transaction. The Publisher may end the coins programme subject to thirty (30) days' notice, during which the coins remain usable.

Games between members. The Platform lets Members play each other one-on-one (“heads-up”): a ranked game or a challenge sent to another Member. These games are free: they cost no coins and no other consideration. They are played with chips specific to each game, which have no value, cannot be bought, converted or transferred, and disappear when the game ends.

No advantage. Whatever its result, a game between Members pays out no coins and no advantage of any value. The chips of a game are never converted into coins or into any other item of the Platform.

Conduct at the table. Members treat each other with respect. Quick phrases and items thrown during a game are meant for fun, never to harass or humiliate an opponent. Each Member can mute their opponent's phrases and items and report them from the table; every report is reviewed by a member of the Publisher's team, and the phrases, items and mascot moods sent during the reported game are attached to it. A breach of these rules may lead to a sanction in the Community (the space where Members exchange with each other) or to the measures provided for in article 15. A Member whose Community sanction bars them from posting cannot send phrases or throw items at the table while the sanction lasts; they can still play. A sanction imposed during a game applies from the sanctioned Member's next connection to a table.

Games watched live. Ranked games and challenges can be watched live, with no delay, by any signed-in Member. A Member who is playing cannot object, including with regard to a Member they have blocked; a counter shows them how many Members are watching their table, without naming them. The spectator sees the players' display names, avatars (with their frames) and ratings, their plan (unless it is hidden), their stacks, their actions, the phrases, items and mascot moods, and the cards shown at showdown or during an all-in; they never see a player's hole cards until those cards are shown, and never act on the table. The spectator undertakes not to help either player during the game, by any means whatsoever, and not to collect the games they watch by automated means, for example to compile statistics on players; a breach may lead to the measures provided for in article 15 and, for a ranked game, to those of the contest rules. The Publisher may close this mode at any time.

Ratings and rankings. Ranked games change a playing rating, and season rankings order Members by that rating. Ratings and rankings only measure playing level; they confer no advantage outside a contest governed by separate rules (next paragraph).

Contests. Any contest with prizes organised by the Publisher, for example on a season ranking, will be governed by separate rules, published on the Platform before it opens, setting out the conditions of entry, how prize recipients are designated and the prizes. In the event of conflict, those rules prevail over these Terms for the contest concerned.
