Terms and Conditions of Use and Sale

These terms and conditions of use and sale ("Terms") define the terms and conditions of access to and use of the Pok Genius platform, accessible at www.pokgenius.com, as well as the conditions under which the Subscriptions, Bootcamps and coaching services offered on the Platform are sold.

Registration, use of the Platform or any order implies full and complete acceptance of these Terms. The applicable version is the version in force on the day of the order.

• Platform: the pokgenius.com website and all of its features
• User: any person accessing the Platform
• Member: any User with an account on the Platform
• Publisher: the company publishing the Platform (see Legal Notice)
• Content: all information, text, images, videos and data available on the Platform
• Subscription: a paid plan, of monthly or annual duration, giving access to the features described in the subscribed offer
• Bootcamp: an online group training session organized on a specific date
• Coaching: an individual session with a coach, scheduled on an agreed date

Pok Genius is an online poker training platform offering:

• Ranger GTO: a library of interactive preflop and postflop ranges with frequencies and EV
• Trainer GTO: hand-by-hand training with instant feedback
• Pro Videos: strategy videos by professional coaches
• Pro Coaching: live coaching sessions with professionals
• Bootcamps: online group training sessions organized on specific dates

Access to certain features requires the creation of an account. The User agrees to provide accurate information and to maintain the confidentiality of their credentials. Any activity carried out from an account is deemed to have been carried out by the account holder.

The User must be at least 18 years old to create an account. By registering, the User confirms that they are of legal age.

The account is strictly personal: sharing credentials or the use of a single account by several people is prohibited.

The User agrees to:

• Use the Platform in accordance with its intended purpose and these Terms
• Not attempt to access the data of other users
• Not reproduce, copy or redistribute the content of the Platform
• Not use robots, scrapers or any automated data extraction device
• Not disrupt the operation of the Platform

The Platform offers Subscription plans (monthly or annual) giving access to all or part of its features, as well as one-off services (Bootcamps, Coaching). The details of the offers and their prices, expressed in euros inclusive of all taxes (VAT included), are displayed on the Platform before any order is placed.

Payment is made online by bank card through our secure payment provider Stripe. No banking data is stored by the Publisher. Payment is taken upon subscription and then, for Subscriptions, at each renewal date.

The Publisher may change its prices at any time. For current Subscriptions, any new price is communicated to the Member at least thirty (30) days before it applies and only takes effect from the next renewal date; the Member remains free to cancel before that date.

In the event of a payment failure, access to paid features may be suspended after notification, and the Subscription then terminated if the situation is not remedied.

Subscriptions are taken out for a period of one (1) month or one (1) year depending on the plan chosen. They renew automatically by tacit renewal for an identical period, unless cancelled by the Member before the end date of the current period.

The Member may cancel their Subscription at any time, free of charge and without justification, from their personal area (Profile → Subscription, secure management portal) or by contacting support. Cancellation takes effect at the end of the current period: the Member retains access to paid features until that date, and no further payment is taken afterwards. The current period remains due and is not refunded, even partially (see article 9).

The Member may change plans at any time. When upgrading to a higher plan, the price difference is calculated pro rata for the remaining period; when downgrading to a lower plan, the change takes effect at the next renewal date.

In accordance with Article L215-1 of the French Consumer Code, reproduced below:

"For fixed-term service contracts containing a tacit renewal clause, the professional service provider shall inform the consumer in writing, by dedicated personal letter or email, no earlier than three months and no later than one month before the end of the period allowing rejection of the renewal, of the possibility of not renewing the contract concluded with a tacit renewal clause. This information, provided in clear and comprehensible terms, shall state, in a prominent box, the deadline for non-renewal. Where this information has not been sent to the consumer in accordance with the provisions of the first paragraph, the consumer may terminate the contract free of charge at any time from the renewal date. Advance payments made after the last renewal date or, in the case of contracts of indefinite duration, after the date of conversion of the initial fixed-term contract, shall in that case be reimbursed within thirty days from the termination date, less the sums corresponding, up to that date, to the performance of the contract. The provisions of this article apply without prejudice to those which legally subject certain contracts to specific rules regarding consumer information." In accordance with Article L221-18 of the French Consumer Code, consumers in principle have a period of fourteen (14) days to exercise their right of withdrawal from a contract concluded at a distance. This right is however subject to statutory exceptions that apply to the services offered on the Platform:

• Subscriptions and digital content: in accordance with Article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium where performance has begun before the end of the withdrawal period. By taking out a Subscription, the Member expressly requests immediate access to all the content and features covered by their plan, and acknowledges that they expressly waive their right of withdrawal as soon as this access is granted. This consent and waiver are collected at the time of payment.
• Bootcamps: in accordance with Article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure activity services to be provided on a specific date or during a specific period. Registration for a Bootcamp is therefore final upon payment.
• Coaching: coaching sessions scheduled for a specific date fall under the same exception. For services not covered by it, a Member who requests performance of the service before the end of the withdrawal period expressly waives this right once the service has been fully performed (Article L221-28, 1°).

Subject to statutory warranties and to the cases expressly provided for by law:

• Amounts paid for a Subscription are non-refundable. Cancellation takes effect at the end of the period and the current period remains acquired by the Publisher, including if the Member does not use, or no longer uses, the service.
• Bootcamp registrations and Coaching session purchases are non-refundable, except in the event of cancellation by the Publisher: in that case, the Member is fully refunded within fourteen (14) days, or offered a transfer to a later session.

These provisions do not deprive the Member of the statutory warranty of conformity applicable to digital content and services (Articles L224-25-1 et seq. of the French Consumer Code) or of any right that cannot be waived. In the event of a service malfunction, the Member is invited to contact support at contact@pokgenius.com.

Bootcamps: Bootcamps are online group training sessions, organized on specific dates and subject to available places. Registration is only final after full payment. The program, dates, duration and price of each Bootcamp are specified on its presentation page. The Publisher may cancel a Bootcamp, in particular if the number of participants is insufficient; the Member is then informed as early as possible and fully refunded or, at their choice, registered for a later session.

Coaching: individual coaching sessions are scheduled by mutual agreement with the coach. Any session cancelled by the Member less than 48 hours before the agreed time, or not attended, remains due. A session cancelled by the coach is rescheduled free of charge.

All content on the Platform (text, images, videos, software, databases, ranges, algorithms) is protected by intellectual property law and belongs exclusively to the Publisher.

Access to the Platform does not grant the User any intellectual property rights over the content. Any unauthorized reproduction or use is strictly prohibited.

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

The Platform is provided "as is". The Publisher strives to ensure the availability and reliability of the service, but does not guarantee uninterrupted or error-free operation.

The Publisher cannot be held liable for:

• Temporary service interruptions for maintenance or updates
• The results obtained by the User in their poker practice
• The User's use of the information and content of the Platform
• Indirect damages resulting from the use of the service

Warning: Pok Genius is a training tool. Poker involves financial risks. The GTO strategies presented are theoretical references and do not guarantee gains.

The Publisher reserves the right to modify these Terms at any time. Changes take effect upon their publication on the Platform. The User will be informed of substantial changes by email or notification on the Platform.

Continued use of the Platform after modification constitutes acceptance of the new Terms. Orders already placed remain governed by the version accepted on the day of the order.

The Member may delete their account at any time from Settings → Account → "Delete my account", or by contacting support. Deleting the account does not in itself terminate a current Subscription: the Member is invited to cancel their Subscription beforehand (article 7).

The Publisher may suspend or delete an account in the event of a violation of these Terms (in particular account sharing, content extraction, fraud), after notifying the User. In the event of a serious violation, the suspension may be immediate and does not give rise to any refund.

These Terms are governed by French law. They are drawn up in French; in the event of any discrepancy between the French version and a translation, the French version shall prevail.

In the event of a dispute, the parties undertake to seek an amicable solution before any legal action: the Member may send a written complaint to support (contact@pokgenius.com).

In accordance with Articles L611-1 et seq. of the French Consumer Code, the consumer may, after first submitting a written complaint to the Publisher that has not received a satisfactory response, have free recourse to a consumer mediator. The contact details of the competent mediator are available on request from support and will be published on this page as soon as the mediator is appointed.

Failing an amicable resolution, the French courts shall have jurisdiction under the conditions of ordinary law.
